HC summons Kushtia SP over ‘misbehaviour’ with magistrate
The court asked him to appear before it on 25 January to place his explanation
The High Court has summoned Superintendent of Police (SP) in Kushtia SM Tanvir Arafat for allegedly misbehaving with Senior Judicial Magistrate Md Mohsin Hasan.
The High Court bench of Justice Mamnoon Rahman and Justice Khijir Hayat on Wednesday asked him to appear before it on 25 January to place his explanation regarding the matter.
SP SM Tanvir Arafat allegedly misbehaved with Md Mohsin Hasan during Bheramara municipality election on 16 January.
The next day, the senior judicial magistrate filed a complaint to the Election Commission, and the registrar general of the Supreme Court against SP SM Tanvir Arafat, citing misconduct during a local government body election.
Later, the court came up with the order in a suo moto move when the matter was brought to its attention.
According to the complaint, upon receiving an allegation from a voter that a group of people were sitting inside Bheramara Pilot Model High School polling centre and trying to manipulate voters, the magistrate entered the centre.
He there found some people sitting inside the polling booth with the polling agents and asked them to show their identity cards.
When the magistrate started talking with the presiding officer to know about those people, SP SM Tanvir along with around 40-50 members of the police force entered the polling station and called the presiding officer.
Additional Superintendent of Police Mostafizur Rahman and some policemen asked the presiding officer to go with him, barring him from talking with the senior judicial magistrate.
Even after the magistrate identified himself, the SP approached the magistrate and asked, "Who are you? What are you doing here? The SP then rudely asked the magistrate to leave the centre," the complaint adds.
"When the SP passed in front of me with his force, He again said addressing me, who sends these people here! What are you doing here? Get out from here," the magistrate said in the complaint.
Senior Judicial Magistrate Md Mohsin Hasan informed the Bheramara Upazila Nirbahi Officer about the incident after SP SM Tanvir Arafat left the centre.
